There were better phones than the iPhone going back to 2003. And there were good, but very expensive and heavy Windows tablets, Fujitsu being the most notable producer.

Apple's innovation was dumbing down the devices. Apple's brilliance was reducing functionality to make them simpler to use and fit the available hardware at the time. SJ's marketing genius is undeniable.

Apple loses in Japan

Have you read the information about why the Jury reached the decision they did? I found this interview with the jury foreman very convincing:

That doesn't sound like "bully tactics" to me; it sounds like Samsung deliberately acting in a way that Google themselves were very unhappy with.

The daft thing about that Google email and this trial is that as you say the jury were very swayed by it. Sure looks like a smoking gun.

But let's look a little closer at this email, shall we?

The email is about the look and feel of the Galaxy Tab vs the iPad.

And yet the jury ruled that the Tab did not infringe on the iPad's design.

So why was this taken as a smoking gun for the phone infringements?

Now yes, back then we were talking about Froyo or Honeycomb, so they were much more similar. However, the emails talked about 'design of the front side', which suggests at least some concern regarding hardware rather than just UI.

But that's not the point: the jury ruled that there was no infringement here. It's inconsistent.
