Unless the image is protected by copyright or trademark (my avatar is protected by both), I do not see a problem. If you feel strongly about it, talk to the guy and I am sure you could come to an amicable resolution.

Oh Jon, that is one ugly little penguin. I doubt you will have to worry about people using it in the same way as your old one. You are right, it would be a courtesy, maybe that is why the moderators are not willing to make this into a rule. We're all adults here, and being courteous is well, while not always the norm, not something that should have to be enforced with numerous heavy handed rules.

It's only your interpretation that it's "rude", Jon. This is not something that we have any rules about. To repeat, if you want to guarantee uniqueness, create your own avatar. What's so hard about doing so? Just take a photograph of something that appeals to you, or draw something.
