A Modern Instance is an important literary novel, one that deals with divorce as its subject matter.

"To build a work of fiction around the subject of divorce was, in 1882, a fairly radical step, but in choosing it, Howells made available to his imagination a whole series of perplexing questions about the nature of American society: the role of the family; the status of women; the functions of property; and, not least, the moral foundations of law. At one point or another, A Modern Instance addresses all of these issues and struggles to maintain a coherently conservative attitude toward them."
