In this instance I think that the estate of JD.Salinger, did the right thing.

Swedish author Fredrik Colting was trying to cash-in on somebody else's work.

This is an injunction from publishing based on a copyright violation. Its not a ban of an allegedly purient book. The thread title is misleading, but tech-dirt's use of the word ban was inappropriate as well. I would think that in the case of a site where so many people advocate not pirating and giving authors their due that people would have a little more respect for a decision that protects the original author's work. Copyright law is a complicated animal at the best of times, but as this was a settlement and not an adjudicated case, I can't really speak to whether or not the court got it right.

As to the settlement details, the court can't make the man not dedicate the book to Salinger... that is why this is a settlement not a court order. Clearly that was a term that the Salinger estate brought and that the defendant agreed to. Were a court to order that, it would not, in all likelihood, survive a constitutional challenge.

I'm happy to see this, since it was obviously a derivative work. Not to mention the fact that I never thought Catcher needed a sequel. I would be much more interested in seeing Hapworth 16, 1924 released as a novella.

The article says quite clearly:

It's not a ban. It's not a law. It's not a decision handed down by a court. It's a settlement, an agreement, a deal. In other words, the author voluntarily agreed not to sell the book in the US, in return for some benefit granted by the estate (such as them agreeing to drop their legal action).

To entitle this thread "Another book banned in the US" is just codswallop.

Today I made a great agreement, a deal. I voluntarily agreed to give a mugger my wallet in return for a benefit granted by him - not shooting me.

More like, voluntarily agreed to return a wallet to the children of the dead man it was stolen from in return for not being prosecuted for the theft.
