Germany Halts Distribution Of Galaxy Tab 10.1 In Europe (Except Netherlands) In Apple

The judge backed Apple’s claim that Samsung’s tablet had infringed on its intellectual property and copied elements of the iPad 2.

While Samsung can appeal against the judgment, the injunction will still stand in the meantime. Any appeal would be heard in around four weeks' time and would be heard by the same judge.

Since patents are not law, that is not an issue. Unfortunately, it is completely legal for companies to obtain frivolous patents and then use them to stifle innovation, as Apple has been doing.

I second Dave_S opinion: it is not a legal issue, but it is still not fair-play, nor very intelligent. The Samsung Tab has been awaited with great anticipation in Germany, Samsung is a very present brand there. Apple is not doing their sinking image any good with such methods.

Now, I would be interested in your opinion on this. Be brave, do not just open a thread and post some provocative little sentences to accommodate it with your sauce, enlighten us with your opinion on this Samsung -Apple battle (and if you can, do please elaborate).

Patents are established by the law, and should not be violated, again as established by the law.. How does a company legally enforcing proper use of its property stifle innovation? This makes no sense. Apple did not release the first tablet. There were many on the market before the iPad. Why did Samsung not copy those other tablets? Apple didn't copy them, it tried something new. Samsung should try something new too.

Anyway, this is not a patent issue.

It's in german, sorry for that, but to clarify what it says is that the court did agree to halt the distribution momentarily to study the case and that it is not a patent breach case but a design copying case. Apple managed to have the distribution blocked in Europe by accusing Samsung of design copying, after trying (until now without success) to do the same in the US. The first decision of the Düsseldorf court does not mean at all that Apple will win their case in the end, whether in Europe or in the US.

Samsung might though change the design (again) of their Tab under the pressure not of the law nor of the media, but because Apple happens to be one of their biggest client in the chips business.

And I don't think that for Apple the problem is the Tab. I think it is the success of the Galaxy phones.
