This is ridiculous. My Moon+ reading app turns pages like this...so do a lot of online store flyers. So now they have to pay Apple or remove this ability? I'm so glad I don't own any Apple products.

Wow that is bad. They submitted it less than a year ago. How the heck can a patent be granted on something that is common at the time you submit the application? 5 minutes of research should have disqualified it. Who is issuing these patents, a bunch of monkeys?

Out of interest, does anyone know who has to pay legal costs if Apple sue based on this patent, but the patent is then ruled invalid due to prior art?

I guess Apple wouldn't be liable because they were granted the patent, and so had an 'obligation' to sue to defend it, and the accused party wouldn't be liable as they would be exonerated. I imagine they'd both have to pay their own costs, which is fine for a company with deep pockets like Apple, but could be painful for smaller companies who get targeted.

Not exact at all. Here's the one line claim:

"CLAIM The ornamental design for a display screen or portion thereof with animated-graphical user interface, as shown and described."

The description is just those three images and the sentences as described in the report.

It is incredibly vague, includes no code, or indeed animation, just those three intermediate states.

If it is to be argued that it would apply to any animation that passed precisely through those states then it's so narrow it's meaningless. If it is to be argued that it applies to anything that has a graphical animation that 'turns a page' as indicated, then it's so broad it's surely undefendable.

The killer line is:

I can't see how Apple's patent doesn't fall foul of this prior patent application from Microsoft:

Even if this one hasn't yet been approved, it was filed in July 2010, nearly a year and half before Apple filed their application, which I can't see as other than a specific instance of this.

Doesn't the Microsoft application indicate prior art?
