Not at all. With the hundreds of android phones on tHe market it would be a miracle it it didn't have 68% (or more) of the market. Apple has one phone model in a few configurations. The truly annoying idea is that one corporation is eating another's lunch when the people who actually own buying decisions regarding said lunch are the consumers.

The mere fact that companies and even journalists now think in these terms makes me think we're all captive buyers in their eyes -- they view capitalism as a de facto monopoly in which we're forced to give predetermined recipients money.

How about a headline like this?:

"Consumers Choose Android over iOS Increasingly: Apple Humbled, Google CEOs Weep with Gratitude."

Well, Windows only has a few versions (Home, Business, Ultimate I think), and yet it has a larger percentage of the desktop market than Android has on the smartphone market. So I don't think you can correlate multiple choice with massive market share. Likewise, Linux has a plethora of distributions, yet its market share is minuscule.

Linux is always going to be behind the 8ball because it isnt licenced, so its not marketed to any particular group. Watch things change if one or more of the large companies (eg Dell, HP) start actively marketing Linux as a viable alternative to Windows.

In any case, comparing the desktop market to the smartphone market is just a furphy, and distracting from the original argument which is that android is eating apple's lunch. And I am saying that is not a bit surprising, considering the sheer numbers of phones out there with android on them. Drawing comparisons with desktop market is just fluff and froth. no substance.

This tentative rejection was first reported by Foss Patents and while it is only tentative, it goes to show there could be some fissures and cracks in the flagship patent Apple has been wielding. The one that claims a "touch screen device, method, and graphical user interface for determining commands by applying heuristics."

If some of its claims were ultimately found to be invalid, it could have drastic retroactive effects on the ruling in the big Apple vs Samsung case. On the other hand, if they are ultimately found to be valid, the patent will be stronger than ever for having survived an additional round of USPTO scrutiny.

This isn't the first Apple patent to be tentatively invalidated. The same thing happened to their bounce-scroll patent back in October. Of course Apple is going to muster its best legal minds to defend these key patents, and its legal team has proven to be savvy in the past, so this is by no means the definitive end of this patent. But it could be the beginning of it. Maybe.

Speaking of patents, I am surprised that Apple didn't get one particular patent and that is the one covering where the phone sits on the table right next to a person's right hand or at least on the right side (for right handed people of course) until the time comes to pick it up and finger it a bit.

This is pretty much what Google does with Android. It offers a more-or-less standard platform for software developers, users get a somewhat standard interface between devices, and hardware developers have an enormous amount of incentive to address different markets. Linux is licensed. It is just that the licensing is so flexible that most people don't recognize the thing being licensed as Linux or the license as being a license. It is probably a sure bet to say that Linux dominates the market: Android is built on Linux, most ereaders are based on Linux, wireless routers are frequently running Linux. Even Televisions use Linux.

You've taken my comment out of context, I was referring specifically to the desktop computer. However, your general point is well taken. Even the Tomtom GPS device has Linux under the hood.
