PaidContent: Judge Throws Out Lawsuit Against Apple Over ‘iBrick’

http://paidcontent.org/article/419-j...e-over-ibrick/

Quote:
Bianca Wofford of San Diego sued Apple last year after downloading the company’s iOS 4 operating system to her iPhone. She claimed that this software upgrade was actually a “downgrade” for her and others using the company’s older model 3G phone. In a colorful complaint, she accused Apple of deliberately turning consumers’ 3G iPhones into slow-running “iBricks” in order to induce them to buy the newer iPhone 4.
Lawsuit aside, the reality was, at least from my experience, that the original iOS 4 "upgrade" made the iPhone 3G almost unusable-slower, prone to crashing, and with serious issues with the camera/photo library. One could argue that Apple didn't have a responsibility to offer an upgrade at all to a 2 year old phone, but once they did, they should have made sure it worked before releasing it.

It promotes jailbreaking. Doesn't Apple realize that? At least they should allow the default firmware to be installed that came with device.

What sucks more? If you are offline for some reason, you can't install firmware from IPSW. It has to be signed online.

Microsoft has played a completely different game. WP OS is also "in prison"; but if you pay 10 more bucks, they make the device open for life. Look at THIS. It really induces you to buy a new device. "BUY ONE MORE. BUY ONE MORE."

Love how Microsoft is starting to come to terms with the hacker community-not just with WinPhone7 but also the Kinect-some great stuff coming out of that work.
