Are these public domain books only ? If it's the case, you can do anything you want with it. OCRing and reformatting a public domain book doesn't create a "new copyright" for it: http://www.teleread.org/blog/?p=6901

The books are generally (if not all) available from the multiple Black Mask sites (i.e.: Silk Pagoda) so there is no reason to duplicate the efforts or resources that have already gone into them. It is far better that we make mention of his sites than that we post duplicate copies of his work. Additionally, as pointed out in another thread, most of his books are created in batch rather than the hand crafted approach used in the upload sections here.

What is copyrighted in his books is the unique Black Mask Table of Contents.

Duplicating resources in what concerns our precious ebooks is never a waste of time or effort. Sites are being shut down everyday. The more copies of the collections circling around the better. PG for instance hosts its own DVDs, asks people to download them, to ship them to other people and to upload them to all P2P networks they can.

One can have a "compilation copyright" on a collection of material, even if the individual contents of the collection are in the public domain.

Eg, in the UK, the telephone directory is protected by copyright, even though all the information it contains is in the public domain.

In the case of the BlackMask DVD, things like their indexes, etc, will be protected by copyright, and one could not duplicate the DVD without BlackMask's permission.

But the books will be in public domain if the content is not changed. Once in the public domain the original content cannot be copyrighted again.

Yes, the individual books could certainly be redistributed provided, as you say, that no new content has been added. I was referring to copying or redistributing the entire DVD.
