unwanted extra chapter break

i make a toc with sigil and then i convert the resulting epub to mobi for use on my k3. when i have a section header and a chapter header on the same page, digital editions displays this:

Part III
Chapter 7

Text....

at the top of a single page, but after i convert it to a mobi with calibre, kindlePreviewer, mobireader and my k3 all display 'Part III' on a page by itself. is there a known remedy for this?

Most likely, under structure detection in the conversion options delete whatever is set for 'insert page breaks before'.

ah, and i habitually turn of heuristic processing when i do a final epub->mobi conversion
