It is one of the exceptions to the DMCA set by the Library of Congress, see Wikipedia: DMCA.

There is no mention of having to be disabled. And some people who would need a read aloud feature might not be able to break the DRM themselves. So yes, it is legal for me to rmove the DRM from MS Reader eBooks.
