In normal tort cases, the plaintiff pays the 30-40% and there are no additional fees, taxes, etc. Of course the real key is that there are no fees if you lose, of course.

There are other kinds of cases - civil rights cases, specifically - where the attorney fee can exceed the settlement by a small multiple. That is by design - the point is to give someone the ability to sue police (or whoever) for violating civil rights, even if the actual damages are small.

Some sort of system that prevented complete windfalls would be reasonable, I think (i.e., if the attorney puts in 3 hours of work and the defendant settles, the attorney shouldn't get 1/3 of a large settlement and should be required to take an hourly rate).

But no attorney would take a typical $15,000 accident case for $750 - considering the time spent interviewing witnesses, reviewing medical document, getting estimates, etc., it would not be worthwhile. (Particularly if you only get that amount if you win.)

And are there any restrictions on the amount that the defendant can spend on his attorney?

I would not say it is uncommon, but it does happen. Unknowing lcient with sleazy lawyer.

Typically the lawyer gets some set percentage of the settlement or award, around 1/3. And that covers all their costs and fees. But there have been cases where the lawyer made the contract read that they got X% PLUS all their costs and fees. So the lawyer billed for his time and all the other costs, and that on top of their X5, leaving the plaintiff with a very small recovery.

One big case was back int eh 80s where several fire fighters sued over smoke inhalation. IIRC there was a $10 million award, the plaintiffs got to split about $125,000. The lawyers got the rest.

If that was the best she could do while hiding her age, getting "outed" isn't going to be much help.
The "harm" may be real.

Just not sure she has a case, especially if IMDB can prove the info was publicly available somewhere else and they *didn't* get it from her CC data, as she claims. That she had to come clean to keep the case alive doesn't bode well.
Methinks her crusade might be best directed at the Hollywood casters. And that, alas...
