This is ridiculous. My Moon+ reading app turns pages like this...so do a lot of online store flyers. So now they have to pay Apple or remove this ability? I'm so glad I don't own any Apple products.

Wow that is bad. They submitted it less than a year ago. How the heck can a patent be granted on something that is common at the time you submit the application? 5 minutes of research should have disqualified it. Who is issuing these patents, a bunch of monkeys?

Unbelievable. Can't imagine it holding up in court.

Out of interest, does anyone know who has to pay legal costs if Apple sue based on this patent, but the patent is then ruled invalid due to prior art?

I guess Apple wouldn't be liable because they were granted the patent, and so had an 'obligation' to sue to defend it, and the accused party wouldn't be liable as they would be exonerated. I imagine they'd both have to pay their own costs, which is fine for a company with deep pockets like Apple, but could be painful for smaller companies who get targeted.

Isn't the patent actually for that exact graphical method of indicating a page turn?
So not actually for turning pages at all.

Not exact at all. Here's the one line claim:

"CLAIM The ornamental design for a display screen or portion thereof with animated-graphical user interface, as shown and described."

The description is just those three images and the sentences as described in the report.

It is incredibly vague, includes no code, or indeed animation, just those three intermediate states.

If it is to be argued that it would apply to any animation that passed precisely through those states then it's so narrow it's meaningless. If it is to be argued that it applies to anything that has a graphical animation that 'turns a page' as indicated, then it's so broad it's surely undefendable.

Link to the patent itself.

The killer line is:

Quote:
The process or period in which one image transitions to another forms no part of the claimed design.
This suggests that regardless of the way it's implemented, or the speed of the animation, the patent claims it.

If it has those three exact stages, yes.
Otherwise no.

Your initial statement implied that the woman that got conned is a fan. I don't think that she is, I think that she is just a regular consumer. You do agree that not all consumers are fans, so I don't see what the problem is.

I can't see how Apple's patent doesn't fall foul of this prior patent application from Microsoft:

Quote:
One or more pages are displayed on a touch display. A page-turning gesture directed to a displayed page is recognized. Responsive to such recognition, a virtual page turn is displayed on the touch display. The virtual page turn actively follows the page-turning gesture. The virtual page turn curls a lifted portion of the page to progressively reveal a back side of the page while progressively revealing a front side of a subsequent page. A lifted portion of the page is given an increased transparency that allows the back side of the page to be viewed through the front side of the page. A page-flipping gesture quickly flips two or more pages.
Even if this one hasn't yet been approved, it was filed in July 2010, nearly a year and half before Apple filed their application, which I can't see as other than a specific instance of this.

Doesn't the Microsoft application indicate prior art?

Or indeed, this demo for a Silverlight application from 2008:

http://msdn.microsoft.com/en-us/magazine/cc507644.aspx

Quote:
PageTurn is the quintessential Silverlight 1.0 demo.
