This is no different then a rectangle and a rectangle with rounded corners.

That was related to the technology for 3G that Samsung had licensed as FRAND to Intel. The 4G patents are much newer, and at the moment I don't think we know which ones Samsung are going to claim are infringed.

What we do know is that Samsung has a good history of innovation in this area, with over 800 patents, while Apple had no 4G patents a year ago. Since then they've developed 44 and bought another 300 or so.
