If Big Publishing wants special antitrust exemptions, take it up with Congress; don't try to pressure the DOJ with irrelevancies and astro-turf campaigns. Not in an election year. I noted a wee bit of testiness in the replies. Good.

Some interesting things I noticed after a quick read through:
DOJ does have Amazon's financial and sales data. Amazon monopoly is "highly speculative." B&N had taken "considerable market share" from Amazon before Agency pricing. Apple, Microsoft, Google and Sony have committed considerable assets in ebooks despite Agency pricing. Enforcement of publisher discounting is voluntary. DOJ will not monitor. |

Sure Apple and Barnes & Noble don't have to discount if they don't want to. The DOJ isn't going to force them to have sales. Seems fair to me.

Its not surprising that the DOJ thought it got it right with is settlement proposal.

Define lose. Personally I would see lots of different retailers existing as a good thing. It would allow specialisation of the same kind that we used to have in real shops in the UK before we got conned into thinking "competition" was good for consumers. Look how that one ended. A handful of books in grocery shops to choose from. But as long as they're cheap, yeah?

Would agency pricing in digital music be a good thing?
Right now, Itunes/Apple/GooglePlay/eMusic/Zune selling MP3 using wholesale. As a result, they can offer discount to customers (if they want). Anyone want to advocate that the major labels (Universal + EMI, Sony Music Group, Warner Music Group) should be allowed to control the final price of MP3? In other words, the final price for all digital songs and all digital albums will be fixed. Is that a good thing?
