Not quite the same situation, but I've had books mysteriously vanish from my Kobo account on two occasions now, and dealing with customer service to get them back was a nightmare.
I cannot stress enough that everyone should be backing up their Kobo books as soon as they buy them, and not just relying on Kobo's cloud. It's not particularly difficult and it can save a lot of hair-pulling later.
