If anyone is interested in reading about the actual case the court will be deciding, there is a good explanation of the basic issues here.

Interestingly, Justice Kagan, who recused herself the last time this issue came up, leading to a 4-4 affirmance of the circuit court's decision, will be the deciding vote.
