More to the point, not everyone has a webcam so how would you determine who should get the fine? It wouldn't really be cost-effective to inspect people's computers for evidence.

In the UK, at least, someone acting on behalf of the copyright holder (usually for a share of the profits from any early settlements) collects IP addresses and contacts the ISP for a list of account holder details to send threatening letters to.
