I exported one of their free public domain ebooks (based on the Google book scans) and it downloaded as a DRM-free ePub. I also bought and exported an ebook from a publisher who requires DRM and it downloaded as an .acsm file which (as usual) Adobe Digital Editions exchanged for an ePub with Adobe DRM.
To my mind this is good, because a) Google did not go with a new DRM scheme, and b) Adobe DRM is easily stripped.
Note that Google also provides the option of downloading as a PDF with Adobe DRM. Also, the non-Agency ebook price was identical to Amazon (65% off list price).
