The daft thing about that Google email and this trial is that as you say the jury were very swayed by it. Sure looks like a smoking gun.

But let's look a little closer at this email, shall we?

It was for a tablet and Google was concerned that for the sake of their operating system that the look and feel and the methodology that they [Samsung] were using to create their tablet was getting too close to what Apple was doing.
It was "for a tablet".

The email is about the look and feel of the Galaxy Tab vs the iPad.

And yet the jury ruled that the Tab did not infringe on the iPad's design.

So why was this taken as a smoking gun for the phone infringements?
