One Mac blogger noted that the license defines a work as being created by iBook Author. If that's true, then there's no problem. No one else uses that format, so the store is pretty much the only place that files created in iBook Author can go.

The problem is that Apple still requires an ISBN to publish in the iBookstore. As long as that's the case, I'll keep going through Smashwords to get my work into that store.
