It is much better if the original creator modifies his version and replaces the upload.
Anyway, as far as I know the NCX should not contain any entity at all, so even would be wrong, it should use the corresponding Unicode character instead. Or better yet, write "THE PREFACE", no need to have spaced-out text in the TOC.
