This behavior isn't intentional. On KT/PW the Menu button isn't disabled when in KUAL. I will log it as a defect. I don't know if there's a way to enable it (other than fixing the code, if possible).

Looks like an x but it isn't. It's a cross character and stands for "close". It isn't a shortcut.
