Assuming the appeal is rejected and this patent is invalidated, it would regardless appear that AOL's prior patent for rubber-banding stands. So presumably AOL could sue Samsung if they wanted to (and Apple?), though given that they don't make phones perhaps the outcome would be uncertain.

This also has an impact on the Apple vs Google/Motorola case which was lost on infringement of rubber-banding:

Wasn't it rubber-banding that forced Samsung to change the gallery app in Touchwiz to avoid an injunction in Europe, as well?
