"Copyright and Fair Use" at Stanford Law School reports that the defendant publisher, RDR Books, has filed an appeal (http://recordingindustryvspeople.blogspot.com/2008/11/harry-potter-lexicon-decision-appealed.html) from the Judge's decision in Warner Bros. Pictures v. RDR Books, the case involving the Harry Potter Lexicon.

The one who has the best lawyers, usually the side with the most money, wins. But this time, the underdog has a decided advantage in that the Stanford Law school is backing them. There are a lot of very clever, very idealistic legal types in the Bay Area

What are the grounds on which they are appealing? No matter how "clever" their lawyers might be, this was such a blatant case of copyright violation that it's very difficult to see how the original verdict could possibly be overturned.
