does Amazon have the capability to fix known issues with the kindle on the fly so to speak? I have a kindle on backorder and am wondering whether Amazon is "tweaking" the kindle already. Seems to me there are some issues present, as in all new tech items and being an early adopter has its risks...

Should be very easy for Amazon to push new updates directly on the Kindle using EVDO. Lab126 (http://www.lab126.com/) must be working right now on fixing those problems, and creating new features for the Kindle.

Yep, Kindle has a capability for OTA (Over-the-air) firmware update. What's more, if the update is not marked as optional, it's downloaded and applied automatically and you can't decline it :)

All current Kindle owners are now waiting for an update via wireless. It will show on the settings screen, which until now has shown ver. 1.0 -- the upgrade occurs when your Kindle is in sleep mode with the wireless switch on. It is supposed to occur over the next several weeks. Mine hasn't happened yet, but I check from time to time.

The update is not 1.1. It's 1.0.4.
